Trainings with representatives of Social Services Offices

On the implementation of the project: “Increasing the access of
violated women and girls in the justice system and a better
implementation of the law no.9669, date 18.12.2006, “On measures
against violence in family relations” through strengthening the
Social Services Offices as one of the main responsible authority
with certain legal responsibilities.”
According to the law no.9669, date 18.12.2006, "On measures
against violence in family relations", article 13,(3) "The
subjects legitimated to ask protection orders", the
representatives of the Offices of Social Services in
municipalities or communes are subject legitimated to submit
directly in the court, the request signed by them, the request
for urgent protection orders for all violated persons, so for
women and minors who are the most violated groups.
Although according to
article 13 (2) of the same law, the representatives of the
Offices of Social Services in municipalities or communes are
subject legitimated to submit directly in the court, with the
request signed by them, (the representatives of the Offices of
Social Services in municipalities or communes) the request for
protection order for minors, there are no cases of fulfillment
of this responsibility. There are no cases of victims of
violence in family relations assisted with the preparation of
the request for protection order by the representatives of these
offices.
Regardless that
according to the article 15 of the law no.9669, documents issued
by the representatives of the Offices of Social Services in
municipalities are proves in the judicial processes of
protection orders, there is no case in which these offices to
play this role.
These conclusions are
based on the monitoring reports of the Center for Legal Civic
Initiatives on the implementation of the law “On measures
against violence in family relations” for the period June 1,
2007-April 31, 2008 and for the period April 31, 2008 up to June
1, 2009.
It is another
component in which the role of this authority is very important.
The role of the representatives of the Offices of Social
Services is very important in the enforcement of the court
decisions of urgent protection orders and protection orders.
According to article 23 of this law, the court decisions of
protection orders and urgent protection orders are enforced also
by unit of local power, (municipality and communes).
From the second
monitoring reports prepared by the staff of the Center for Legal
Civic Initiatives for the period April 31, 2008 up to June 1,
2009, it has resulted a poor role of the social centers near
local power, on the implementation of this law.
With the aim of strengthening the role of the offices of social
services on the implementation of the law no.9669, date
18.12.2006, the Center for Legal Civic Initiatives has organized
trainings with representatives of these offices during the
period December 2009-January 2010. These are the trained
representatives of the municipality and local unit:

Some of the issues of the trainings with representatives of
social services offices are:

the monitoring of the implementation of the law no.9669,
date 18.12.2006, “On measures against violence in family

në familje dhe detyrat e tyre: policia, organet e qeverisjes
vendore, organet qendrore;

Urgent protection
orders and protection orders. Material and procedural
aspects. Problems of the enforcement of the court decisions
on issuing urgent protection orders/ protection orders.

Making the
participants capable on the preparation of the requests for
issuing urgent protection orders/protection orders. A case
law and separation of the participants in groups;

The
responsibilities of the units of local power.
(municipalities and communes) The Sectors of Social Services
of the units of local power.

The role of the
units of the social services on protection of the victims of
violence in family relations.
-
The role of the
offices of the social services regarding the enforcement of
the protection order/urgent protection order.
These trainings are serving to establish a good cooperation
between representatives of the offices of social services and
the Center for Legal Civic Initiatives, which is expected to be
concretized with free legal assistance in cases of domestic
violence identified and supported by the representatives of
these offices.
The lawyers of CLCI
are in very closed contact with the trained representatives
during the whole period of the implementation of the project.
The lawyers of CLCI will assist them in the drafting of the
requests for urgent protection orders/protection orders, in
submitting the requests for urgent protection orders in the
court, in the enforcement of the court decisions, in assisting
with psycho social support and free legal aid for the victims of
violence in family relations with which they are faced.
9 trainings in total will be organized under the frame of the
implementation of this project with representatives of the
offices of social services near Municipality of Tirana and units
of local power.
